In booking or participating in any activity or experience through Extreme Things, LLC or Extremethings.com (hereafter referred to as the “Extreme Things”), the booking and/or participating customer agrees to be bound by the following terms and conditions:
Reservation Requirements & Restrictions
Prior making a reservation every person for whom the reservation pertains must meet the minimum activity or experience requirements with respect to age, health, height, weight, physical ability, proficiency, valid driving license, etc. where applicable. Once a reservation is confirmed, the customer may be liable for charges if the activity has to be cancelled because the requirements are not met.
When making a reservation and prior to participating in an Extreme Things’s activity or experience, the booking customer must provide each participant’s full name, affirm that each participant meets the minimum requirements for the activity or experience, and provide any other information (e.g. participant waivers, emergency contact numbers, etc.) as may be reasonably requested by Extreme Things and the activity or experience vendors and/or service providers.
Booking and Availability
Activity or experience reservations can be booked through the Extremethings.com online reservation system or via telephone by calling our customers service line. All reservations are subject to availability on first come, first served basis and require advance credit card payment.
In some cases, the availability of fixed-date reservations may not be known until confirmed with the instructor, vendor, or service provider. In such cases, the customer’s credit card will not be charged, but a credit card authorization is still required. Such authorization will be released if the requested availability cannot be met. If availability is confirmed, the credit card payment will be processed and the booking customer will receive an email from Extreme Things confirming the reservation. All email correspondence will be sent to the email address Extreme Things has on file for the booking customer.
A Fixed-Date reservation is a reservation for a specific date and/or time. Until availability is confirmed, the requested reservation dates and/or times shall be considered a pending or requested reservation.
Confirmation Email
Once a pending reservation is accepted, the booking customer will receive a Confirmation email which should be printed and brought with the participants when meeting the vendor or service provider for the very first time. The Confirmation email is the booking customer’s Receipt of Purchase and contains the activity or experience Confirmation Code which can be used to identify the customer’s reservation.
Additionally, the Confirmation email will contain all of the relevant details of your experience such as where participants are to meet, driving directions, what to bring or wear, contact information for the vendor or service provider, etc.
Participant Conduct & Responsibilities
For safety, the participants of the activity or experience must always follow the instructions of the guide, instructor, or trainer of the chosen activity or experience. Failure to comply with the authority of the guide, instructor, or trainer will cause the participant(s) to be expelled from the activity without refund.
Additionally, failure to show for a reservation and/or or failure to comply with activity requirements such as adequacy of clothing, footwear, equipment, proficiency, experience, timeliness, etc. will disallow customers to participate in the activity and cause the booking customer to forfeit all money paid.
It is the responsibility of the booking customer to provide all necessary information to every person for whom the reservation pertains. It is also the responsibility of the booking customer to ensure that every person for whom the reservation pertains meets the minimum activity or experience requirements and is suitably disposed and agreeable to participating the activity or experience.
The booking customer assumes full responsibility to inform every person for whom the reservation pertains of these terms and conditions of participation in an Extreme Things’s activity or experience, and any subsequent liability for failure to do so.
Discounts & Coupons
All discounts, savings, or coupons must be requested or provided by the booking customer at the time the reservation is made.
In general, Extreme Things offers a 10% discount for groups of 10 or more participants so long as a single payer or credit card is used in making the group’s reservation. The group discount is not applicable to all Extreme Things’s activities and experiences.
Cancellations and Refunds
Extreme Things and its customers must abide by the cancellation policies of its vendors and service providers. As such, any cancellation, amendment, or refund of an activity or experience must be approved by the activity vendor or service provider. In general, however, once an activity or experience has been scheduled, reserved, or confirmed, it may NOT be cancelled, rescheduled or changed in any way, except due to inclement weather.
Where reservation cancellations and/or rescheduling is granted, Extreme Things will apply at a 10% administration charge on the total cost of the activity or experience reservation.
Weather
Many Extreme Things activities and experiences are dependent on the weather and participants are advised to call the applicable vendor or service provider to check the weather before setting out. PARTICIPANTS SHOULD ALWAYS ASSUME THE EXPERIENCE WILL TAKE PLACE UNLESS THEY HEAR OTHERWISE FROM THE VENDOR OR SERVICE PROVIDER. However, Extreme Things cannot guarantee that the activity or experience will not be withdrawn by the vendor or service provider if weather conditions on the day of the reservation deteriorate or render the activity or experience unsafe. If the customer’s event is cancelled due to inclement weather their activity or experience will be rescheduled.
Activity/Experience Descriptions, Pictures, and Durations
The timing, descriptions and photographs of any activity or experience contained in the Extremethings.com website, company brochure, information pack, or otherwise communicated are intended only to present a general idea of the activity or experience and shall not be binding to Extreme Things.
Session durations are approximate and are given simply as an indication of the time participants will spend with an activity or experience. Additionally, wait time may be involved.
Inclusivity
Extreme Things welcomes the participation of disabled people to its activities and experiences, although the Company recognizes that certain activities and experiences may present difficulties for those with disabilities. Extreme Things is committed to ensuring that disabled customers are given every opportunity to participate in an activity or experience, so it asks that customers inform the company about any relevant disability at the time the reservation is made. This enables Extreme Things to do its best to meet the participant's particular needs.
Complaints
Extreme Things is an advocate for its customers and will do everything it can to ensure all its customers have a fantastic experience or work on their behalf to rectify any issues customers have with an Extreme Things’s vendor or service provider. HOWEVER, if a customer has a problem or complaint on the day of their activity or experience, please bring it to the attention of the vendor or service provider on-location as soon as possible so they have a chance to put matters right. In general, Extreme Things considers it unreasonable if participants take no action during an event, but then request a refund at a later date.
Indemnification
The booking customer agrees to release, waive, discharge, hold harmless, defend, and indemnify Extreme Things, its subsidiaries, affiliates, officers, employees, agents, representatives, and other third parties, from any and all claims, actions, losses, liabilities, or demands, including reasonable attorney's fees, made by any participant under the booking customer’s reservation due to or arising out of the participant’s use, participation or enjoyment of an Extreme Thing’s activity or experience.
Other Terms and Conditions
While Extreme Things takes every care in choosing its vendors and service providers, inclusion of an activity or experience in the Extremethings.com website, company brochure or other marketing material does not mean that Extreme Things guarantees the safety standards or satisfactory performance of any of the vendors or service providers.
Extreme Things's liability for any claim or breach of obligation regarding any reservation, activity, or experience shall not exceed the price of that reservation, activity, or experience.
All the above terms and conditions apply as a condition of using any reservation, whether or not the participant is the original purchaser or booking customer.
