    ACKNOWLEDGEMENT OF RISK      

In using an Extremethings.com voucher, the Member/Participant acknowledges and agrees to the following:

  1. The Member/Participant acknowledges that the purpose and scope of Extreme Things, LLC and Extremethings.com (hereafter referred to as “the Company”) is to distribute vouchers for services provided by other organizations to persons interested in sports, outdoor and leisure activities, and through the use of the Extremethings.com website, to enable them to obtain bookings, benefits, and other entitlements from various businesses, entities and groups, who may, from time to time, offer benefits to the Company's members and voucher recipients.


  2. The Member/Participant acknowledges and agrees that, upon undertaking any activity sponsored, promoted, or otherwise sold by the Company, he/she releases the Company from any liability whatsoever with respect to any injuries, loss or damages which may be sustained by the Member/Participant in the course of undertaking any activity, whether dangerous, hazardous or not.


  3. Further, the Member/Participant acknowledges that the Indemnity extends to injuries sustained in the course of undertaking activities which may be deemed to be caused by the alleged negligence of the Company, or due to circumstances which may have been avoided.


  4. The Member/Participant unconditionally agrees to fully Indemnify the Company and all it's servants, agents, vendors, operators, and employees against any injury, damage or accident that may be sustained by the Member/Participant, while participating in activities organized, arranged, sold, or distributed by the Company or the Entities and Groups who offer various services to the Company and also includes activities won as prizes.


  5. The Member/Participant warrants that he/she does not suffer from any Medical Condition and/or incapacity which may impair the Member/Participants ability to participate in Company Activities and further, that the Member/participant does not suffer from any Heart Condition, Epilepsy or other Medical Condition which may result in the Member/Participant potentially placing himself/herself in a position of risk, by undertaking the Company's Activities.


  6. The Company and its operators reserve the right to cancel an activity at any time in the event of adverse weather conditions or equipment failure or other reasonable and unforeseen cause arises.


  7. The Company will not be responsible for any loss, injury or damage incurred or suffered by the participant during the activity or in the event the activity is cancelled or postponed.


  8. The Company shall use its best endeavors to ensure the safety of the Member/Participants while participating in the Company's Activities, HOWEVER, the Member/Participant agrees to accept ALL RESPONSIBILITY FOR ANY AND ALL INJURIES the Member/Participant may sustain while participating in Company Activities, NO MATTER WHAT THE CIRCUMSTANCES OF THE ACCIDENT AND/OR INJURY.


  9. THE MEMBER/PARTICIPANT PLEDGES THAT NO LEGAL ACTION WILL BE INITIATED BY IT AGAINST THE COMPANY, ITS CLIENTS, ITS AGENTS, EMPLOYEES, INSTRUCTORS, AND/OR PERSONNEL, DUE TO ANY ACCIDENT OR INJURY SUSTAINED DURING THE COURSE OF UNDERTAKING COMPANY ACTIVITIES.
